‘The law was made to take over the Waqf’, what arguments did Kapil Sibal give before CJI Gavai?

Hearing on the issue of interim order in the petitions challenging the Waqf Amendment Act 2025 began in the Supreme Court on Tuesday. The petitioners challenging the law asked the Supreme Court to impose an interim stay on the law. Senior advocate Kapil Sibal, opposing the law, argued that it is being said that this law is for the protection of Waqf, while its purpose is to take over the Waqf.

During the hearing, the Supreme Court also asked the petitioners opposing the law about the legal necessity of registering the Waqf and the legal consequences of not registering it. The central government will present its side in the matter on Wednesday.

Many petitions are pending in the Supreme Court challenging the legality of the Waqf Amendment Act 2025. A bench of Chief Justice BR Gavai and Justice AG Masih is hearing the case. The petitions challenging the Waqf Amendment Act 2025 have also demanded an interim stay on the law, while on the other hand, the central government has opposed the interim stay in its reply filed in the court, justifying the law.

Apart from the petitions challenging the Waqf Amendment Act, two more petitions were on hearing in the apex court which challenged the original Waqf Act and demanded the cancellation of the original Waqf Act 1995 and 2013, terming them discriminatory towards non-Muslims. The court has issued notice on these petitions of Harishankar Jain and Parul Kheda, but the Centre has not filed its reply yet. However, the number for hearing on these petitions did not come on Tuesday.
